Terms of Service

Effective and last updated October 31, 2026

In short: opentab is free, provided as is, and in beta. The app checks in with our server, and we can disable a copy that breaks these terms. Use it lawfully, don't resell or rebrand it, and read the Privacy Policy to see what we collect.

1. Agreement

These Terms of Service ("Terms") are an agreement between you and Adam Proksch, trading as Adam Proksch Creative ("we", "us", "our"). opentab is a division of Adam Proksch Creative, not a separately incorporated company. They cover your use of:

You accept these Terms by installing, opening or using the Services. If you do not agree, do not use them. If you use the Services for an organization, you confirm that you have authority to accept these Terms for it.

Some documents are part of these Terms: the Software License, the Acceptable Use Policy and the Privacy Policy. If the Software License conflicts with these Terms on how you may use or copy the App, the Software License applies.

2. Eligibility

You must be at least 13 years old to use the Services, or the higher minimum age for digital consent where you live (for example, 16 in some EU countries). If you are under 18, or under the age of majority where you live, a parent or guardian must review and accept these Terms for you.

3. Beta software

opentab is in beta. Features may change, break or be removed without notice. It may have bugs, crash, slow down or lose data, including tabs, bookmarks, history, notes and settings. Keep backups of anything important. Do not rely on opentab for safety-critical, medical, legal or financial work.

4. License to use the App

We license the App to you; we do not sell it. The Software License sets out your rights. In summary, you may use it free of charge for personal, non-commercial purposes, and we may revoke that license.

5. Check-ins, notices and remote disabling

The installed App connects to our server when it starts and about every 30 minutes after that (a "check-in"). The Privacy Policy lists the data a check-in sends. By using the installed App, you agree to check-ins. The portable build and development builds do not check in.

When the App checks in, our server can reply with:

We disable a copy only to enforce these Terms or the Software License, to stop abuse, fraud or security threats, or to comply with the law. When we disable a copy:

If the server cannot be reached, the App keeps working normally. If we discontinue opentab, we will announce it on opentab.cc in advance where we reasonably can.

6. Updates

The installed App may download and install updates automatically, including when you quit it. Updates may add, change or remove features. These Terms apply to all updates. We are not required to provide updates, support or any particular feature.

7. Your content and data

The App stores browsing data on your computer, including history, bookmarks, tabs, notes, settings, permissions, background images and imported browser data. You own that data and are responsible for it. We do not receive it, except for the check-in data described in the Privacy Policy and anything you choose to send us, such as a support email.

When you send us feedback or suggestions, you give us a free, worldwide, perpetual license to use them without restriction or payment.

8. Third-party websites and services

opentab is a web browser. The websites you visit and the services you connect, such as Spotify, Google accounts, search engines and media services, belong to other companies. Their own terms and privacy policies apply. We do not control them and are not responsible for their content, availability or practices. See Third-Party Services.

Built-in features such as ad and tracker blocking, the music player, imports from other browsers and sign-in helpers may stop working whenever a third party changes its service. Blocking ads or trackers may break some sites or conflict with a site's terms. You are responsible for following the terms of the sites you use.

9. Acceptable use

You must follow the Acceptable Use Policy. In particular, you must not use the Services to break the law, harm others, interfere with our systems, or forge, tamper with or flood check-ins.

10. Our intellectual property

We and our licensors own the Services, including the App, the Sites, their code and design, and the opentab name and logo. These Terms give you no rights to them beyond the license in Section 4. Use of the name and logo is covered by the Trademark & Brand guidelines. Open source parts of the App are covered by their own licenses; see Open Source Notices.

11. Fees

The Services are currently free. If we start charging for any part of them, we will tell you before you are charged. No one else is authorized to sell opentab. If you paid someone for it, you did not get it from us.

12. Privacy

The Privacy Policy explains how we handle personal data.

13. Suspension and termination

You may stop using the Services at any time. To do so, uninstall the App and delete its data folder.

We may suspend or end your access to all or part of the Services, revoke your license or disable your copy, as described in Section 5, if:

Where the law requires it, we will give notice and a reason, and we will consider any appeal sent to support@opentab.cc. When access ends, you must stop using the App and delete it if your license was revoked. Sections 7 and 10 and Sections 14 to 19 continue to apply after access ends.

14. Disclaimer of warranties

To the fullest extent the law allows, the Services are provided "as is" and "as available", with all faults and without warranties of any kind, whether express, implied or statutory. These include warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, security and uninterrupted or error-free operation. We do not warrant that ad or tracker blocking will stop all ads, trackers or malicious content, or that the Services will keep your data safe from loss.

15. Limitation of liability

To the fullest extent the law allows, Adam Proksch Creative and its owners, contributors and affiliates are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages. They are also not liable for lost profits, data, goodwill or use, or for any loss arising from your use of, or inability to use, the Services, including disabling of your copy. This applies even if we were told such damages were possible. Our total liability for all claims relating to the Services is limited to the greater of the amount you paid us for the Services in the 12 months before the claim and US $50.

Some jurisdictions do not allow certain warranties to be excluded or certain liability to be limited. In those places, the exclusions and limits above apply only as far as the law allows. Nothing in these Terms limits liability for fraud, gross negligence, wilful misconduct, death or personal injury caused by negligence, or anything else that cannot be limited by law. Nothing in these Terms affects rights you have as a consumer that cannot be waived.

16. Indemnity

To the extent the law allows, you will defend, indemnify and hold harmless Adam Proksch Creative and its owners and contributors from claims, losses and costs, including reasonable legal fees, that arise from your misuse of the Services or your breach of these Terms.

17. Governing law and disputes

Before filing a claim, please email contact@opentab.cc and give us 30 days to try to resolve the dispute informally. These Terms are governed by the laws of the State of California and applicable US federal law, excluding conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Any dispute will be heard in the state or federal courts located in California, and you and we consent to their jurisdiction. If consumer protection law where you live gives you the right to bring a claim in your local courts, or to rely on the mandatory laws of your country, you keep that right.

Time limit. To the extent the law allows, any claim relating to the Services must be filed within one year after it arises, or it is permanently barred.

California users. Under California Civil Code §1789.3, California users are entitled to the following notice: you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210. The Services are currently free of charge.

18. Changes to these Terms

We may update these Terms. The "last updated" date shows when they last changed. If a change is material, we will give reasonable notice, for example on this site or in the App. Using the Services after a change takes effect means you accept it.
